1. conditions of sale
In order to create a contract between you and us please follow the simple on screen instructions taking you through the process of placing an order on the website. To place an order for the products select “Checkout", "Confirm Order details" page, "Confirm my Order". In doing this you offer to buy the Goods at the prices indicated as well as any applicable delivery charges. We will send an automated order acknowledgement email to you, listing the products you have ordered. Please note that this email is merely an acknowledgement of your order and not an acceptance or confirmation of your order by Mitchell-Finch Design Ltd.

The acceptance of your order and the completion of the contract between you and us will take place on dispatch of the products unless we have notified you that we have not accepted your order or you have cancelled it. Once we have accepted your order it becomes binding, subject to your rights of cancellation. Non-acceptance of an order by us will occur in circumstances including: we identify a pricing or product description error; the ordered product is out of stock or unavailable; or if we are unable to obtain authorisation for your payment.

2. pricing and availability
We reserve the right to withdraw any products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this Website whether or not that product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

The product price, as displayed, is inclusive of UK VAT at the appropriate rate.

3. our products
Our products are handmade and/or hand-painted and therefore may have slight variations in colour, texture and finish.  These are not considered flaws. 

We make every effort to portray the colour of our products accurately; however actual colours depend on the calibration of your computer display.  

4. customs
If your order is to be delivered outside the European Union, it may attract import duty and local sales taxes which customers will need to pay on receipt of the shipment. Any additional charges for customs clearance must be borne by you. These rules vary by country and your local government determines duty and customs charges, so you should contact your local customs office for further information.

5. cancellations
You have the right to cancel your order at any time before you receive the products you ordered, by contacting us. If these Products have already been assigned or dispatched when you contact us, you may return them within 7 days of receipt of delivery to receive a full refund.

6. workshop booking cancellations
If we have to cancel a workshop for which you have pre-paid a booking, we will refund you 100% of the booking price.
If you wish to cancel a workshop booking:

• up to 3 weeks (21 days) before the workshop date, we will refund you 100% of the booking fee.
• up to 1 week (7 days) before the workshop date, we will refund you 50% of the booking fee.
• within 1 week (7 days) of the workshop date, we will refund you 20% of the booking fee, as we will have lost the opportunity to easily refill your place on the workshop.
• there will no refund if you simply fail to turn up on the day.

7. returns

You may return your purchase for a refund within 28 days of receiving it. Simply post the item(s) back to us at the address listed on this page.
Your statutory rights on cancellation are not affected.

Refunds will be honoured any time within 28 days of receipt of your purchase.
Please note, all delivery and custom charges incurred on returns made will be your responsibility. We are not responsible for return postage other than for incorrect, mis-described or faulty items, so please attach the correct postage. Sadly, we cannot be responsible for parcels that fail to reach us, so please make sure you obtain a certificate of posting as proof of purchase.

We ask that you return the items in good condition, with all the original packaging and tags intact.

We aim to process all returns within 7 days of reaching us and will email or write to confirm when this has been done. Sometimes the limitations of the banking system mean that the refund may take a further few days to show up on your card statement.

8. Deliveries
Deliveries are usually made Monday to Friday from 8am-5pm.

We use the UK Post Office and UK couriers to deliver your mitchell-finch order.  A signature is usually required for delivery - please let us know if you would like your order delivered to an alternative address.

A calling card will usually be left by the postman or courier if there is nobody to accept the delivery. Please note, if an item is returned to us due to a failed delivery a subsequent delivery charge will be payable to resend the item/order.  

9. Intellectual Property Rights
(a) The Site and its content are protected by intellectual property rights, including copyright and trade marks, as detailed in our Intellectual Property Notice. Mitchell-Finch Design Ltd. reserves its rights in respect of this.

(b) Except as expressly authorised by us or relevant third parties, you agree not to copy, download, adapt, alter, modify, rent, lease, loan, sell, distribute or create derivative works of any content of the Site, in whole or in part.

10. Disclaimers
(a) Your use of the Site is at your sole risk. The Site is provided on an "as is" and "as available" basis and we do not guarantee that the Site will be suitable for your purposes or requirements. If your PC does not support relevant technology including encryption, you may not be able to use certain services or access certain information on the Site.

(b) The Site is accessed via the World Wide Web which is independent of us. Your use of the World Wide Web is solely at your own risk and subject to all applicable national and international laws and regulations. (d) We reserve the right to vary the terms from time to time, such variations becoming effective immediately upon posting to the Site and by continuing to use it, you will be deemed to accept any such variations.
